By your use of the Website or purchase of products through the Website, you agree to these Terms and Conditions. Please read them carefully. By using the Website or purchasing products through the Website, you agree that all agreements, notices, disclosures and other communications that Band of Angels provides to you electronically satisfy any legal requirements that such agreements, notices, disclosures and other communications be in writing.

Please be advised that the Band of Angels jewelry items available in our Online Shop are intended for the discerning adult lover of fine crystal and may be purchased only by adults with a valid credit card according to para. 2 hereafter.

Your order

Band of Angels only sells products to adults who can purchase its products using a credit card. By purchasing a product using this Website, you represent to Band of Angels that you are an adult and that you are authorised to make the purchase using the credit card account information you provide. When you use this Website, you are responsible for maintaining the confidentiality of your access information and for restricting access to your computer. You agree to accept responsibility for all activities that occur on your computer relating to any use of the Website or any purchase of Band of Angels's products through your computer.

Completion of a purchase

Credit card payment, Paypal and iDeal are the only forms of payment Band of Angels accepts for products ordered by you through the Website. Any orders placed by you on this Website constitute a binding offer by you to conclude a purchase with Band of Angels. The binding purchase agreement comes into existence only when Band of Angels accepts your order on the Website by sending you an e-mail or written communication, or by shipping the products ordered.

Taxes

When Band of Angels is required by law to collect applicable taxes relating to your order, you authorize Band of Angels to charge the applicable taxes to your credit card.

Reservations and exceptions

Band of Angels reserves the right to change prices, terms, specifications and warranties for products on this Website at any time  without prior notice. Band of Angels attempts to post accurate information, but errors may sometimes occur. Any such errors in product specifications, descriptions, and pricing will be corrected when discovered and Band of Angels reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions, including after an order has been submitted. If an error in pricing is discovered after your order has been submitted, Band of Angels will inform you of the error at which time you may cancel or reaffirm your order at your option.

Product availability

Once Band of Angels accepts your order, it will attempt to promptly fill the order subject to available inventories. Should an item  not be available, we kindly ask you to try back again or visit your local authorised Band of Angels retailer.

Terms of payment

The purchase price for the products ordered by you is due upon the shipment of your order by Band of Angels. Upon shipment,  Band of Angels will charge the credit card account you identified when your order was placed for the purchase price, the cost of shipping and handling and applicable taxes. You may not make any set off against Band of Angels's claim for payment unless the amount set off is not disputed by Band of Angels or has been the subject of a final and binding judgement against Band of Angels.

Delivery and reservation of title

The products ordered by you will be delivered to the address entered by you through a delivery service selected by Band of Angels. You agree that the products ordered and sent to you remain Band of Angels's property until full payment has been received by Band of Angels.

Right to cancel the purchase

You may cancel this purchase for any reason up to two weeks following your receipt of the ordered products. If you cancel this purchase, Band of Angels will, upon receipt of the returned products, refund or credit any payments you have made for the ordered products.

You may obtain further information and assistance concerning the return of the products ordered by selecting "MY ACCOUNT" from the Website menu. To cancel the purchase, you must send a written notice to the address specified above in paragraph 3 within two weeks of your receipt of the products, or send the products back to the following address for delivery within two weeks of your receipt of the products:

If you cancel the purchase by written notice, you must return the products to this address within 30 days of the cancellation. In case you cancel the purchase you are responsible for the costs of and arrangements for the shipment of the products to be sent back to Band of Angels. You must take reasonable care that the products are not damaged during their return.

Warranty and limitation of liability

LIMITED WARRANTY

Band of Angels warrants for a period of two years, beginning on the date of your receipt of the products, that its products are free from defects in materials and workmanship. This warranty is extended only to you, as the purchaser of the products, and not to any subsequent owner of the products.

You may return defective products to us within two years of the date of your receipt of the products for replacement (subject to product availability) or a full refund, at Band of Angels's option.

Include in the returned materials a written statement of the following: your telephone number, your full address, the date you received the products and the nature of the defect.

You are responsible for the costs of and arrangements for the shipment of the products to be sent back to Band of Angels. In the event Band of Angels determines that your warranty claim is justified, Band of Angels will refund to you the necessary costs of shipment through the U.S. Postal Service. You must take reasonable care that the products are not damaged during their return.

BAND OF ANGELS HEREBY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

THIS WARRANTY REPRESENTS BAND OF ANGEL'S ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY FOR DEFECTS IN MATERIALS AND WORKMANSHIP. BAND OF ANGELS WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS PRODUCT, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH MAY VARY, FROM STATE TO STATE.

The exclusion or the limitation of liability for damages according to the above paragraphs also applies to potential claims against employees or authorized representatives of Band of Angels.

Prohibition of assignment

You may assign your contractual rights under these Terms and Conditions to a third party only with Band of Angels's prior written consent.

Privacy

Band of Angels will use your personal data to process the order(s) which you have placed and for market research to improve its product range. The data is stored and processed by Band of Angels. The data will not be sold to or shared with any other third parties. Band of Angels may send you select advertisements for Band of Angels products or notices of special promotions and other opportunities to buy and of Angels products. If at any time you do not wish to receive and of Angels advertisements or notices of future and of Angels promotions, please contact Band of Angels customer support.

Disclaimers and limitations of liability relating to use of the website
